Welcome to FlyMag.com (“FlyMag,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the website located at https://www.flymag.com (the “Site”) and any related content, newsletters, services, or features we provide (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy and Cookie Notice (together, the “Agreement”). If you do not agree, do not use the Services.

1) Who May Use the Services

  • You must be at least 13 years old (or the age of digital consent in your country) to use the Services.

  • If you create an account or subscribe to our newsletter, you must provide accurate information and keep it updated. You’re responsible for any activity under your account and for safeguarding your login credentials.

2) Informational Content Only (No Professional Advice)

FlyMag is a media and information website. Content may include opinions, reviews, tips, and general travel information. We do not provide professional, legal, medical, tax, immigration, or travel agency services. You are solely responsible for verifying timetables, visa rules, airline policies, health requirements, and other travel details with official sources before booking or traveling.

3) Content and Intellectual Property

  • Our Content. The Services—including text, graphics, logos, images, videos, design, compilation, and software—are owned by or licensed to us and protected by intellectual-property laws. You may make personal, non-commercial use of the Services. Any other use (including reproduction, distribution, public display, or derivative works) requires our prior written consent.

  • User Content. If you post, upload, or submit comments, reviews, images, or other content (“User Content”), you grant FlyMag a non-exclusive, worldwide, royalty-free license to host, store, publish, display, perform, reproduce, modify for formatting, and distribute such User Content to operate, promote, and improve the Services. You represent and warrant you have all rights necessary and your User Content does not infringe any third-party rights or violate any law.

  • Moderation. We may, but are not obligated to, monitor or remove User Content at our discretion for any reason, including violations of these Terms.

4) Acceptable Use

You agree not to:

  • Use the Services for unlawful, deceptive, or harmful purposes or to violate others’ rights.

  • Scrape, crawl, index, or harvest data from the Services (except via public search engine indexing using a robots.txt-compatible crawler).

  • Interfere with or disrupt the Services, bypass security features, or test vulnerabilities.

  • Post spam, malware, abusive content, hate speech, or sexually explicit material.

  • Impersonate another person or misrepresent your affiliation with any entity.

5) Third-Party Services, Links, and Embedded Content

The Services may link to or embed third-party websites, tools, widgets, maps, booking engines, social media, or payment services (collectively, “Third-Party Services”). We do not control and are not responsible for Third-Party Services, and different terms and privacy practices may apply. Your use of Third-Party Services is at your own risk.

6) Advertising, Affiliate Links, and Sponsored Content (FTC/ASA Compliance)

  • FlyMag may display ads (including Google AdSense or similar networks) and use affiliate links (e.g., to airlines, OTAs, hotels, cards, tours, or gear). If you click an affiliate link or make a purchase, we may earn a commission at no additional cost to you.

  • We may publish sponsored content or accept complimentary products or services. We disclose material connections and sponsorships clearly in accordance with applicable advertising and endorsement guidelines.

7) Analytics, Cookies, and Google Services

  • We use cookies and similar technologies for functionality, analytics, and advertising. See our Cookie Notice for details and your choices (including consent controls where required).

  • We may use Google Analytics, Google AdSense, Google Tag Manager, YouTube embeds, and reCAPTCHA to protect forms from abuse. Use of reCAPTCHA is subject to the Google Privacy Policy and Terms of Service.

  • Where required by law (e.g., in the EEA/UK), we will request your consent before setting certain cookies or personalizing ads.

8) Copyright/DMCA Policy

We respect intellectual-property rights. If you believe content on FlyMag infringes your copyright, please send a notice that complies with 17 U.S.C. §512(c)(3) (or applicable law) to our designated agent:

9) Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and share information, and your rights under laws like the GDPR/UK GDPR and, where applicable, the CCPA/CPRA. Where required, we offer mechanisms to exercise rights such as access, deletion, and objection to processing, and to opt out of the “sale”/“sharing” of personal information for targeted advertising.

10) International Users

We operate from Pennsylvania, United States of America. If you access the Services from other jurisdictions, you do so at your own initiative and are responsible for compliance with local laws.

11) Changes to the Services and Terms

We may modify, suspend, or discontinue all or part of the Services at any time. We may update these Terms by posting the revised version and updating the “Last Updated” date. Material changes will be highlighted for a reasonable period. Your continued use after changes means you accept the updated Terms.

12) Disclaimer of Warranties

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT: (A) THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE; (B) CONTENT WILL BE CURRENT, ACCURATE, OR RELIABLE; OR (C) DEFECTS WILL BE CORRECTED. TRAVEL INFORMATION IS SUBJECT TO CHANGE (e.g., schedules, fares, fees, policies, entry rules). ALWAYS VERIFY WITH OFFICIAL SOURCES.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYMAG AND ITS OWNERS, EMPLOYEES, CONTRIBUTORS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED US $100 OR THE AMOUNT YOU PAID US IN THE 6 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, WHICHEVER IS GREATER.

(Some jurisdictions do not allow certain disclaimers or limitations; in those places, our liability will be limited to the fullest extent permitted by law.)

14) Indemnification

You agree to defend, indemnify, and hold harmless FlyMag from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, or your violation of this Agreement or applicable law.

15) Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, sections that by their nature should survive (including ownership, disclaimers, limitations of liability, and indemnity) will survive.

16) Governing Law; Disputes

These Terms are governed by the laws of Pennsylvania, United States of America, without regard to its conflict-of-law rules. Venue and Jurisdiction for any permitted court action will lie exclusively in the courts located in Pennsylvania, United States of America.

  • No Arbitration Clause. Disputes will be resolved exclusively in the courts specified above.

17) Children’s Privacy

The Services are not directed to children under 13. If we learn we have collected personal information from a child under 13 (or the applicable age threshold), we will delete it.

18) Communications

By providing your email address, you consent to receive communications (e.g., newsletters, updates, administrative messages). You can unsubscribe at any time via the link in our emails or by contacting us.

19) Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets, or by operation of law.

20) Severability; Waiver; Entire Agreement

If any provision is found unenforceable, it will be replaced with a valid term that most closely reflects the original intent, and the rest will remain in effect. Our failure to enforce a right is not a waiver. This Agreement constitutes the entire agreement between you and us regarding the Services and supersedes any prior understandings.
